Henry County Probate Court: a family guide

Where the court is, what it charges and how to file there.

This is our family guide to the court. It is not the court's own website. For the court itself, go to the court's own page. Anything the court does not post says “Ask the clerk.”

Step by step

Six steps to start an estate in Henry County

  1. Set out the death certificate and the will, if there is one. Add a list of family names and addresses.
  2. Look at the Estates pages on the Henry court site and at our forms guide.
  3. Call 770-288-7600 and ask whether the court wants the papers in person at Sims Street, by mail, or some other way.
  4. Plan your visit around the lunch break. The court is closed from 11:45 to 1:00.
  5. Pay the filing fee. The state calculator shows $203 for a petition, before publication.
  6. Notice of a will in common form runs for four weeks in the Henry Daily Herald.

These steps give the general path. They do not say which petition fits your family.
