Fayette County Probate Court: a family guide

Where the court is, what it charges and how to file there.

This is our family guide to the court. It is not the court's own website. For the court itself, go to the court's own page. Anything the court does not post says “Ask the clerk.”

Ask the clerk

The court's fee page says it is set by state law and is not a full list. Letters of administration are $205, or $385 with powers, and the $385 includes publication. Year's support is $385 because it includes $180 for publication. The $205 for a will leaves out publication. The common form, No Administration Necessary and year's support amounts come from the state's official fee calculator. A temporary letters petition is $190.

Checked against the court's website on October 17, 2026 for the solemn form and letters of administration rows. Checked against the state's official fee calculator on October 17, 2026 for the other rows.

Step by step

Six steps to start an estate in Fayette County

  1. Collect the death certificate and the will, if one exists. List each relative and where they live.
  2. Read the court's forms and our forms guide.
  3. Call 770-716-4220 and ask whether you can come in, mail the papers, or file online.
  4. Bring or send the fee. Ask what kinds of payment the clerk takes.
  5. Take the oath in front of the judge or a clerk once the court sets it up.
  6. Ask which newspaper runs the notice and what it costs.

These steps give the general path. They do not say which petition fits your family.

  • Judge Landgaard sits with Associate Judge Ginny Duhon.
  • The court's pages do not say whether Fayette takes e-filing, or whether you need an appointment. An older notice from 2020 said appointments only. Ask before you go.
  • A legal notice lists 770-716-4221 as another number. We could not confirm it.
  • Fayette's page did not name a legal organ. Ask the clerk.
