Cobb County Probate Court: a family guide

Where the court is, what it charges and how to file there.

This is our family guide to the court. It is not the court's own website. For the court itself, go to the court's own page. Anything the court does not post says “Ask the clerk.”

The court's year's support line reads two ways on publication, so ask the clerk. Notice by certified mail costs $8.50 for each person.

Step by step

Six steps to start an estate in Cobb County

  1. Pull together the death certificate and any will. Add a list of the family with addresses.
  2. Go to the free clinic or the monthly info session first if you want a lawyer's view before you file.
  3. Pick your route. Cobb takes e-filing through eFileGA. You can also bring the papers to Waddell Street.
  4. Pay the filing fee. The court's own list shows $200 for the petition.
  5. Take the oath the way the clerk tells you. Ask if it can be done by mail.
  6. The estate notice runs in the Marietta Daily Journal. Letters follow once the judge signs.

These steps give the general path. They do not say which petition fits your family.
