Cherokee County Probate Court: a family guide

Where the court is, what it charges and how to file there.

This is our family guide to the court. It is not the court's own website. For the court itself, go to the court's own page. Anything the court does not post says “Ask the clerk.”

Cherokee is not on the state's fee calculator, and the court posts no fee table. The court says a card paid in person carries a 4% fee. Ask the clerk how to pay a mailed request. Call for the exact fee before you send anything.

Step by step

Six steps to start an estate in Cherokee County

  1. Find the death certificate and any will. Write down where each family member lives.
  2. Read the court's forms page and our forms guide.
  3. Call 678-493-6160 to book a filing time. The court takes estate petitions by appointment.
  4. Or mail a finished petition. Ask the clerk what the fee is first, because the court posts none.
  5. Ask the clerk how to pay by mail. In person, a card carries a 4% fee.
  6. Ask the clerk about the oath and where notice must run, since the court's pages do not say.

These steps give the general path. They do not say which petition fits your family.
